RULES OF THE ONLINE STORE transpaleti.eu

I. Definitions.

The terms used in the Regulations mean:

1. Customer - a natural person, legal person or organizational unit that is not a legal person, the specific provisions of which grant legal capacity, which places an Order within the Store;
2. Civil Code - the Civil Code Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
3. Regulations - these Regulations for the provision of electronic services as part of the transpaleti.eu online store
4. Internet shop transpaleti.eu - website available at www.transpaleti.eu, through which the customer may, in particular, place orders;
5. Goods - products presented in the Online Store;
6. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between RYSZARD KUDZIA BLACHDEKER based in Krakow at Antoniego Szyllinga 7, 30-433 Krakow, with the Customer, using the Store's website;
7. Act on consumer rights - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827).
8. Act on the provision of electronic services - the Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204 as amended);
9. Order - the Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Goods with which the payment obligation is related.

II. General provisions

2.1. These Regulations define the rules for using the Online Store available at www. transpaleti.eu.
2.2. These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services.
2.3. The transpaleti.eu online store, operating at www.transpaleti.eu, is run by RYSZARD KUDZIA BLACHDEKER based in Krakow at 7 Antoni Szyllinga Street, 30-433, 30-433 Kraków, NIP: 7351053037, REGON: 356369583, with which Customers can contact the following e-mail address: office@transpaleti.eu
2.4. These Regulations define in particular:
a) the terms and conditions for submitting Orders via the online store;
b) the rules for concluding Sales Agreements with the use of services provided as part of the Online Store.
2.5. In order to use the online store, the customer should obtain access to a computer station or terminal device with Internet access.
2.6. Customers can access these Regulations at any time via the link on the home page of the website www.transpaleti.eu and download it and print it out.
2.7 Consolidation, security, disclosure and confirmation to the Customer of the essential provisions of the Agreement for the sale of Goods takes place via e-mail.
2.8. Information about the Goods provided on the Store's websites, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.
2.9. All products available on the Store's websites are brand new, free from physical and legal defects, and have been legally placed on the Polish market.

III. Rules for using the Online Store

3.1. RYSZARD KUDZIA BLACHDEKER may deprive the Customer of the right to use the Online Store, and may limit his access to some or all of the Online Store's resources, with immediate effect, in the event of a breach of the Regulations by the Customer, in particular when the Customer:
a) provided untrue, inaccurate or out of date data, misleading or infringing the rights of third parties,
b) has infringed the personal rights of third parties via the online store, in particular the personal rights of other customers of the online store,
c) engage in other behaviors that will be recognized by RYSZARD KUDZIA BLACHDEKER as inconsistent with applicable law or general principles of using the Internet or harming the good name of RYSZARD KUDZIA BLACHDEKER.
3.2. A person who has been deprived of the right to use the online store may not register again without the prior consent of RYSZARD KUDZIA BLACHDEKER.
3.3. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.
3.4. The customer is obliged in particular to:
a) not to provide or transmit content prohibited by law, e.g. content that promotes violence, is defamatory or violates personal rights and other rights
b) has infringed the personal rights of third parties via the online store, in particular the personal rights of other customers of the online store,
c) engage in other behaviors that will be recognized by RYSZARD KUDZIA BLACHDEKER as inconsistent with applicable law or general principles of using the Internet or harming the good name of RYSZARD KUDZIA BLACHDEKER.
3.2. A person who has been deprived of the right to use the online store may not register again without the prior consent of RYSZARD KUDZIA BLACHDEKER.
3.3. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.
3.4. The customer is obliged in particular to:
a) not to provide or transmit content prohibited by law, e.g. content that promotes violence, is defamatory or violates personal rights and other rights of third parties,
b) use the Online Store in a way that does not interfere with its functioning, in particular through the use of specific software or devices,
c) not taking actions such as: sending or posting unsolicited commercial information (spam) as part of the Online Store,
d) use the Online Store in a way that is not inconvenient for other customers and for RYSZARD KUDZIA BLACHDEKER,
e) to use any content contained in the Online Store only for personal use,
f) use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.

IV. Procedure for concluding a Sales Agreement

4.1. In order to conclude a Sales Agreement via the Online Store, go to the website www.transpaleti.eu, select the Product, its parameters, taking further technical steps based on the messages displayed to the Customer and information available on the website.
4.2. The selection of the ordered goods by the customer is made by adding them to the basket.
4.3. When placing an Order - until the button "Order with payment obligation" is pressed - the Customer may modify the entered data and the selection of the Goods. To do this, follow the messages displayed to the Customer and the information available on the website.
4.4. After the Customer using the Online Store provides all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information on:
a) the subject of the contract,
b) unit and total price of ordered products or services, including delivery costs and additional costs (if any),
c) selected payment method,
d) selected delivery method,
4.5. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "Order with payment obligation" button.
4.6. By clicking on the button "Order with payment obligation" there is an obligation to pay.
4.7. Sending the Order by the Customer is a declaration of will to conclude a Sales Agreement with RYSZARD KUDZIA BLACHDEKER, in accordance with the Regulations.
4.8. After placing the Order, the Customer receives an e-mail containing the final confirmation of all essential elements of the Order.
4.9. The contract is considered concluded at the moment the Customer receives the e-mail referred to above.
4.10. The sales contract is concluded in Polish, with the content in accordance with the Regulations.
4.11. The contract concluded between the Customer and RYSZARD KUDZIA BLACHDEKER regarding the purchase of a given product at transpaleti.eu is timely and lasts for the duration of the contract. The place of performance related to the purchase of products at transpaleti.eu is the delivery address indicated by the customer.
4.12. The personal data provided by Clients is collected and processed by RYSZARD KUDZIA BLACHDEKER in accordance with applicable law. The customer who makes a purchase on transpaleti.eu agrees to the processing of the e-mail address in order to send a survey enabling the expression of an opinion on the transaction made on transpaleti.eu. The e-mail address will be processed by RYSZARD KUDZIA BLACHDEKER for the purpose of submitting the survey, and the data obtained as a result of the survey will be used to publish the opinion about transpaleti.eu on the Internet.

V. Delivery

5.1. The Goods are delivered to the address provided by the Customer when placing the Order.
5.2. Delivery of the ordered Goods takes place with the participation of specialized postal operators, in the form of courier

5.3. The customer bears the delivery costs specified in the price list indicated in transpaleti.eu in the tab: Payment and delivery.

5.4. The time of delivery of products is no more than 10 days from the date of conclusion of the contract for domestic shipments and 45 days for foreign shipments. The delivery date consists of:

- time to complete the order and ship the goods (up to 3 business days),

- delivery time by the postal operator / courier, depending on the chosen form of delivery.

5.5. The products may have a manufacturer's, importer's or seller's warranty applicable in Poland. The warranty period for each product is shown in the warranty card issued for the purchased product.


VI. Prices and payment methods


6.1. The prices of the Goods provided on the website www.transpaleti.eu are net prices in Polish zlotys and do not include VAT, which is added at the last stage of finalizing the purchase. A receipt or a VAT invoice is issued for each product sold - depending on the customer's choice. The VAT invoice will be delivered electronically to the e-mail address provided by the Customer, unless the Customer clearly indicates that the VAT invoice should be delivered in a traditional form.

6.2. The customer is obliged to pay the price for the product ordered on transpaleti.eu, including delivery costs, no later than within 7 days from the date of the contract. The following payment methods are possible:

a) by bank transfer - to the bank account number:

 

b) on-line payment - payment via PayPal online payments: www.paypal.com.

c) on delivery - cash payment to the courier upon delivery.


VII. The right to withdraw from the contract


7.1. In accordance with applicable law, within 14 days of receipt of the ordered product, the consumer has the right to return it without giving reasons, with the proviso that the services and products are non-refundable, the purchase of which, in accordance with applicable law, cannot be withdrawn. The rules of withdrawal from the contract that the Customer may use, as well as the cases in which the right to withdraw from the contract is not available, are specified in the instruction, constituting Annex 1 to the Regulations.

7.2. The withdrawal form is attached as Appendix 2 to these Regulations.

7.3. The basis for returns is the proof of purchase: a fiscal receipt or a VAT invoice.

VIII. Complaints about the Goods

8.1. RYSZARD KUDZIA BLACHDEKER, as a seller, is responsible for product defects under applicable law. In the case of a sale that is not a consumer sale, the provisions on warranty contained in the Civil Code are excluded.

8.2. Complaints under the warranty may be submitted in electronic form to the address office@transpaleti.eu or in writing to the address Forklift Blachdeker ul. Myślenicka 35, 32-031 Mogilany, Poland.

8.3. The customer has the right to demand a price reduction or to withdraw from the contract, unless RYSZARD KUDZIA BLACHDEKER, immediately and without undue inconvenience to the customer, replaces the defective product with a defect-free one or removes the defect. This limitation does not apply if the product has already been replaced or repaired by RYSZARD KUDZIA BLACHDEKER or RYSZARD KUDZIA BLACHDEKER, has not replaced the product with a defect-free one, nor has the defect removed.

8.4. If the buyer is a consumer, he may, instead of the removal of the defect proposed by the seller, demand that the item be replaced with a defect-free one, or instead of replacing the item, demand that the defect be removed, unless it is impossible to bring the item into compliance with the contract in a manner chosen by the buyer or would require excessive costs compared to the manner proposed by the seller. When assessing the excess of costs, the value of the item free from defects, the type and significance of the defect found are taken into account, as well as the inconvenience to which the buyer would otherwise be exposed.

8.5. The reduced price should remain in such proportion to the price resulting from the contract in which the value of the defective item is to the value of the item without a defect.

8.6. The customer may not withdraw from the contract if the defect is irrelevant.

8.7. RYSZARD KUDZIA BLACHDEKER, recognizes the claim under the warranty within 14 days from the date of its receipt in the correct form. If RYSZARD KUDZIA BLACHDEKER does not respond to the Customer's requests within 14 days, it means that he considered the requests justified.

8.8. The basis for the complaint is the proof of purchase: a fiscal receipt or a VAT invoice.

IX. Complaints regarding the operation of the website.

9.1. RYSZARD KUDZIA BLACHDEKER takes steps to ensure that the Store operates correctly, to the extent that results from the current technical knowledge and undertakes to remove any irregularities reported by customers within a reasonable time.

9.2. Irregularities related to the functioning of the Store may be reported by the Customer in writing to the following address: transpaleti.eu, Forklift Blachdeker ul. Myślenicka 35, 32-031 Mogilany, Poland., By e-mail to office@transpaleti.eu or using the contact form.

9.3. In the complaint, the Customer should provide his name and surname, correspondence address, type and date of irregularities related to the functioning of the Store.


X. Final Provisions

10.1. In matters not covered by these Regulations, the provisions of Polish law shall apply.

10.2. Any disputes related to the services provided by RYSZARD KUDZIA BLACHDEKER under www.transpaleti.eu will be settled by courts of general jurisdiction. The customer who is a consumer has the option of using an out-of-court method of considering complaints and pursuing claims before the Permanent Consumer Arbitration Court at the Małopolska Provincial Inspector of Trade Inspection, ul. Wiślna 3, 31-007 Krakow. Information on how to access the above-mentioned mode and procedures for resolving disputes can be found at the following address: www.uokik.gov.pl, in the tab "Settlement of consumer disputes".

APPENDIX 1

NOTICE ON WITHDRAWAL FROM THE CONTRACT
The customer has the right to withdraw from a distance contract within 14 days, without giving any reason.

Warning! Pursuant to the Act, the right to withdraw from a contract concluded outside the business premises or at a distance is not available to the consumer in relation to contracts: in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy his individual needs.

The withdrawal period will expire after 14 days from the date of delivery of the goods (i.e. the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods).

To exercise the right to withdraw from the contract, you must inform RYSZARD KUDZIA BLACHDEKER about your decision to withdraw from the contract by means of an unequivocal statement - by submitting an appropriate statement in writing or by completing the Return Form attached as Annex 2 to these Regulations, within 7 days and sending them to the following address:

To meet the deadline to withdraw from the contract, it is enough for you to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.

In the event of withdrawal from this contract, we will reimburse you all payments received from you, including delivery costs (except for additional costs resulting from the method of delivery chosen by you other than the cheapest standard delivery method offered by us), immediately, and in any case no later than 14 days from the date on which we were informed about your decision to exercise the right to withdraw from the contract. We may withhold the reimbursement until we receive the item or until proof of its return is provided to us, depending on which event occurs first. We will refund the payment using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise

Please send the item back to us immediately, and in any case not later than 7 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the goods before the expiry of the 7-day period to the following address:

The Goods returned by the Customer should be packed in an appropriate manner, ensuring no damage to the parcel during transport.
You will have to bear the direct costs of returning the goods, i.e. the cost of packaging and returning the goods.
You are only responsible for reducing the value of things resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of things.
The right to withdraw from the contract does not apply to contracts:

1.for the provision of services, if we have fully provided the service with your express consent;
2. in which the price of the Goods depends on fluctuations in the financial market over which we have no control and which may occur before the deadline to withdraw from the contract;
3.in which the subject of the service is a non-prefabricated item, manufactured according to your specifications or serving to satisfy your individual needs.
